Reading that article it occurred to me that that proposal — “If everyone charged with crimes suddenly exercised his constitutional rights [e.g. to a speedy trial], there would not be enough judges, lawyers or prison cells to deal with the ensuing tsunami of litigation.” — represents a real-life prisoners’ dilemma. That is, if the prisoners cooperate with each other, they both go free, but if either one cooperates with the judge, the other loses. Risking one’s own life (sentence) based on trust in another con? Not too likely, and more to the game theory point, not too rational.

    • There’s definitely a collective action problem here that seems insurmountable.
