Breaking a streak of along-party-lines ACA decision, the Sixth Circuit in Cincinnati has ruled that the individual mandate is constitutional. The decision was 2-1, though all three justices agreed the “inactivity” claim currently favored by the right is a non-issue.

Judge Sutton—the first Republican to back the mandate’s constitutionality—was appointed by George W. Bush and is a former Scalia clerk.

UPDATE: Orin Kerr says this is important.
